Request for Order of Supervision

for "No Court Appearance Required" Traffic Citations

The Bond County State’s Attorney’s Office is responsible for prosecuting all Traffic Code violations within Bond County.  You may begin the negotiation process with the State’s Attorney’s Office for an Order of Supervision by completing the following application.

What is an Order of Supervision?  An Order of Supervision is a disposition authorized by the Illinois Code of Corrections which is available for a variety of offenses including most Traffic Code violations.  It is available for offenders who are not likely to commit further crimes and in situations in which it is in the best interest of the defendant and the public that the defendant not receive a record of a conviction.  The obvious benefit to the offender is that there is no conviction entered.

Before completing the application, you should consider the following:

(1)  All traffic citations which do not require a court appearance are considered “petty offenses” and are punishable by a fine of up to $1,000.00.

(2)  You have the right to plead not guilty and demand a trial by judge or jury.

(3)  You may waive your right to a trial and plead guilty and receive a conviction on your record for the offense charged by signing the guilty plea form on the back of the blue copy of the citation and mailing it to the Clerk of the Court, or alternatively, by clicking here .

(4) If you wish for the court to consider the entry of an Order of Supervision in your case, you must appear in court in person or by an attorney.  Alternatively, if you reach an agreement through negotiations with the State’s Attorney’s Office for an Order of Supervision, the State’s Attorney’s Office will, in many cases, agree to waive your personal appearance in open court.  If you are under the age of 18 and wish to request an Order of Supervision, you must appear in open court with a parent.

(5)  If you are under the age of 21, you will be required to complete an approved traffic safety course as a condition of Supervision.

(6)  Orders of Supervision for petty offenses can have a duration of up to 364 days and can include the imposition of a fine in an amount up to the statutory maximum.

(7)  Court costs are incurred with all court appearances, including the entry of an Order of Supervision.

The Bond County State’s Attorney’s Office does not offer any legal advice or guarantees on the effect that an Order of Supervision may have on your driving privileges and/or your insurance premiums.
